1Acceptance and scope

These Terms of Use apply to every Benchius playground and the Benchmark experience (collectively, the Services). By accessing or using the Services, you agree to these terms. If you do not agree, do not use the Services.

Terms, acceptable-use policies, and restrictions imposed by your organization, model provider, cloud provider, or other service provider also apply and may be more restrictive than these terms.

2Lawful and authorized use

You may use the Services only for lawful purposes and in compliance with all applicable United States and international laws and regulations. This includes laws concerning cybersecurity, fraud, privacy and data protection, intellectual property, sanctions, export controls, discrimination, exploitation, and safety.

Only provide prompts, files, data, endpoints, credentials, and other content that you have the legal right and authorization to use. Do not test a third-party model, endpoint, account, network, or dataset without the owner's permission.

3Prohibited AI abuse

You must not use, attempt to use, or help another person use the Services to:

Commit, plan, facilitate, or conceal unlawful, fraudulent, deceptive, exploitative, abusive, harassing, discriminatory, or violent conduct.
Create or distribute malware or phishing material; steal credentials; gain unauthorized access; disrupt systems; or evade security controls, authentication, content safeguards, rate limits, or provider restrictions.
Create or distribute child sexual abuse material, non-consensual intimate content, human-trafficking or exploitation material, or content that unlawfully threatens, targets, or endangers a person.
Violate privacy, confidentiality, publicity, intellectual-property, or other legal rights, including by processing personal, sensitive, or confidential data without a valid legal basis and required permission.
Develop or facilitate unlawful weapons or physical harm, impersonate another person for abuse or fraud, or misrepresent AI-generated content where doing so is deceptive or unlawful.
Make or automate high-impact decisions about employment, credit, housing, education, healthcare, legal services, insurance, or access to essential services without any human review, notice, consent, testing, or appeal required by applicable law.

If a use could harm people, compromise systems, violate rights, or break the law, do not use Benchius for it.

4Your responsibility

You are responsible for your prompts, uploads, endpoints, credentials, configurations, evaluation criteria, outputs, and every downstream use of those outputs. Protect credentials and do not submit secrets or regulated data unless you are authorized to do so and the destination service is approved for that data.

AI output may be inaccurate, incomplete, biased, unsafe, or unsuitable for your purpose. Apply qualified human review before relying on it, especially in legal, medical, financial, safety-critical, or other high-impact settings.

When using Benchmark, compare only models and endpoints you are authorized to access. Respect provider quotas, rate limits, service terms, and safety policies. Benchmark scores and comparisons are experimental results, not guarantees of quality, safety, compliance, or fitness for a particular purpose.

5Usage analytics and operational logs

After you accept these terms, Benchius uses Microsoft Azure Application Insights to measure anonymous page views, sessions, feature usage, reliability, performance, and coarse city, state, and country or region information. Application Insights derives geography during ingestion and masks the stored client IP address.

Azure Container Apps ingress logs measure request volume, status, and latency and can temporarily contain network addressing. Access to those logs is restricted. Telemetry does not intentionally collect prompts, uploads, model responses, credentials, authorization headers, API request or response bodies, or provider endpoint URLs. Clearing browser cookies resets the anonymous visitor identifier. Disconnected PWA usage is not reported until a connected telemetry event occurs.

6Compliance and changes

Access may be limited or terminated when use is suspected to violate these terms, provider requirements, or applicable law. These terms may be updated as the Services and legal requirements evolve; the date above identifies the latest revision.
